It turns out I was mistaken, thinking that Vne is universally expressed in TAS.

A friend who owns and races a G3 Glasiar has his Vne explicitly expressed in Indicated Airspeed, by the kit manufacturer. And it happens that when racing some owners exceed the Vne value by a substantial margin.

On an EAB, who determines Vne? Is it up to the builder, or the kit manufacturer?

If the Vne is published as XXX, can you as the builder/owner increase the value?

Yes, I am familiar with this: VNE is 90 percent or less of the demonstrated dive velocity (VD), a calculated value and/or the speed at which a test pilot flew the plane with no vibration or buffeting severe enough to result in structural damage.
