While talking with a fellow yesterday about his project we came upon the issue of using certified aircraft parts for a homebuilt project.
Specifically, the use of a fuselage or heavily modifying one for a homebuilt and re-registering and inspecting it. This is essentially how many homebuilts of old got their start, but now this is not allowed. I guess there is something to do with the 51% rule, but I'm thinking of something so heavily modified that 51% would not even be a question.

Example: using a tri-pacer (cub, supercub, etc) steel fuselage and using the cabin area only and building new wings. DAR says this is no longer allowed. I struggle with how anyone would really know vs. why it's even an issue since it would be registered as a homebuilt.

Enlighten me please.
