LSA Speed Question

I'm going to be getting my Sport Pilot License and will be building an LSA. I want to make sure I have it right as to the 138 mph maximum. As I understand it, it is the maximum continuous speed of the airplane, not the airplane's speed at max power, or the VNE. Is this correct? One of the planes I'm considering is the BK1, which I originally dismissed because of the max speed of 145mph. However according to the specs on his site, the max continuous cruise is only 130.
