Can a Volmer Sportsman amphibian be a LSA?

The Volmer Sportsman amphibian was designed for a gross weight of 1500 lbs. But if I am the manufacturer can I legally certify and license it at 1440 and fly it legally in the LSA category? I am not trying to be sneaky or anything. Just wondering if it is ok to do. Although I guess it would then be flown over gross but so is every Aeronca Champ. Except the Champ is over design gross and the Volmer would be at the design gross.
Thoughts?
