PART103 Clarification Needed

Part 103, says a ultralight airplane has to have a Power Off Stall Speed of 24knots with a 170lb Pilot to qualify it as an Ultralight.

So an ultralight plane that just meets that 24knots with a 170lb pilot, won't meet them same Spec's with a much heavier 200-368lb pilot.

Is that still OK?

Like a Phionex 103 Ultralight, has a useful load of 398lbs. 398 - 30lbs of gas, leaves room for a 368lb pilot!
